Terms and Conditions

Rights and Usage: Per copyright laws, all media is the property of Bloch Real Estate Photography ("vendor") and can be used by said entity for internal and marketing purposes. Unless prior agreement is made, any media provided is only to be used by the client to market the property photographed until that property is sold. Any use of the media to market the same property for a different listing agreement, to market a different property, for use in the client's personal marketing, or any distribution to unauthorized third parties is strictly prohibited. The client and the client's parent company may use the media only to market the subject property. Any and all other uses (including by unauthorized third parties) must be approved in writing and may incur a fee.

Payment: Payment must be made on the website to access the media unless other arrangements are agreed to.

Vendor Liability: The vendor is not liable for any damages caused while performing services or by use of the provided media.

Client Obligations: Client will ensure that all required consents, as applicable, have been obtained prior to performance of the Services, including any consents required for the performance of Services and the delivery of Work Product by Photographer and, as applicable, from venues or locales where the Services are to be performed or from attendees or participants of the photo shoot.

Client will ensure that all properties are:

• Reasonably accessible to the photographer during the session time agreed upon
• Please have a key, code, or other form of entry available before Photographer arrives
• Free and clear of excess clutter and broom clean
• Free of any persons or animals that might hinder the photography shoot or cause delays
• If people or pets are present that may hinder the shoot or cause delays, please have a plan in place to keep them away from the areas the photographer is working in
• Free of cars or large objects in driveway, if applicable and possible
• Free of any identifying materials of the homeowner(s) or tenant(s)

Failure to meet any of these conditions may result in lesser-quality results and/or a fee of up to 50% of contracted services.

Refunds/Disputes: The vendor agrees to deliver only what is agreed upon between vendor and client. If they have delivered less than the services agreed upon, either a full refund or re-shoot of the property will be provided. Vendor will make all reasonable efforts to ensure services are in accordance with the style of their listed portfolio. If the vendor delivers media that are satisfactory to the agreement but deemed unsatisfactory by the client, please get in touch with us to seek a resolution. However, no resolution is guaranteed, and the vendor has no obligation to satisfy disputes over aesthetic or other preferences by the client.

Cancellation/Reschedule: All cancellations or reschedules must be made 24 hours before the agreed-upon appointment time. Failure to cancel or reschedule before that time can result in a fee of up to 50% of the selected service(s).

Relationship: The vendor is purely freelance and not an employee of the client. The vendor reserves the right to unilaterally cancel any agreements made with the client. If a payment has been made prior to the vendor canceling an agreement without delivery of the requested service (excluding cancellation/rescheduling fees), a full refund will be made to the client.
